Boston is challenging a decision by the transportation department to cancel funding for a project on the basis that it included a small allocation for electric vehicle charging.

The grant was awarded to Boston during Democrat Joe Biden’s presidency under the Rebuilding American Infrastructure with Sustainability and Equity (Raise) programme.

The city argues the Roxbury Resilient Corridors project would improve safety, public transport, accessibility and traffic flow. Three streets identified for improvements are in the top 3% of Boston’s streets in terms of concentration of traffic injuries and fatalities. They are in an area classified by the transportation department as one of “persistent poverty” and a “historically disadvantaged community”.

Boston says the department gave a single reason for withdrawing the grant in September last year: it included electric vehicle charging infrastructure. However, the city contends this accounted for less than 1% of the project’s costs.

The lawsuit argues that the decision was unlawful and overtly political and contradicted the purpose of the Raise programme, which Congress established to support infrastructure projects promoting sustainability, safety and technological innovation, including in underserved communities.

Michelle Wu the mayor of Boston, said: “We’re fighting for every dollar of investment to improve quality of life for Roxbury residents, commuters, and businesses.

“Boston earned this competitive grant to meet community needs and address long-needed infrastructure upgrades. The City of Boston will continue to fight back against lawless federal attacks, and we urge the court to reverse the Trump administration’s illegal actions and restore these critical funds for Roxbury.” Democratic congresswoman Ayanna Pressley whose Massachusetts district includes Roxbury, said: “These funds are an essential investment in Roxbury and the unlawful cancellation of this grant is more evidence of Sean Duffy and Donald Trump’s contempt for the people we serve.”

She added: “There was no good reason to rescind these funds – DOT should reverse course so we can move this project forward, improve the daily lives of commuters, and enhance the climate resilience of at-risk communities—just as Congress intended.” The lawsuit argues that federal agencies cannot change the terms of a programme established by Congress to reflect changing political priorities. The case, City of Boston v Duffy, names transportation secretary Sean Duffy and was filed in the US District Court for the District of Massachusetts.

Boston city says it will have filed nine lawsuits against the administration once the latest case is included, eight of them in partnership with the Public Rights Project.

Toby Merrill litigation director at the Public Rights Project, which is providing pro bono legal counsel to Boston, said: “Boston lost a $20m infrastructure grant over electric vehicle chargers that represented a fraction of 1% of the funding – infrastructure the federal government itself encouraged.” Cities including Chicago, New York and Los Angeles and states across the US have brought a series of lawsuits against the administration over federal funding decisions and other policies since Trump returned to the White House.
