Burry, famous for betting against the housing market before the financial crisis, is leading a group seeking to block the construction of 25 homes uphill from where he lives in a tony Silicon Valley town.

Burry is president of Citizens for Responsible and Equitable Development, which asked a state court to block the hillside project in Saratoga, California, including five homes for lower-income households. Its Sept. 17 complaint alleges the development would overwhelm an evacuation route in the event of a wildfire.

The 55-year-old investor gained renown for betting against the housing market ahead of the 2008 crash, trades chronicled in Michael Lewis’s book In the film version, Burry was played by Christian Bale.

Now Burry is challenging the 72-acre development near his own home in Saratoga, about 50 miles (80 kilometers) south of San Francisco. In a Sept. 23 blog post, Burry argued that additional housing would compound existing evacuation dangers.

“We established CRED to give residents a voice against overdevelopment in the fire-prone Saratoga hills,” he wrote.

The project has been in limbo for months, rejected by the planning commission in July, then unanimously approved by the city council a month later.

Bryan Wenter, a lawyer for the developer Chateau Masson LLC, said the environmental review fully addressed the wildfire evacuation risks.

City officials “had the right to approve and the obligation under state housing law to approve this project,” Wenter said.

Lawyers for CRED couldn’t be reached for comment. Burry didn’t respond to a request for comment. Corinne Mitchner, the city’s public affairs officer, said in an email that the developer can begin work unless a court orders otherwise.

Burry submitted several public records requests, but didn’t directly comment on the project before its approval, Mitchner said.

The challenge drew criticism from YIMBY Action, a pro-housing advocacy group, which argues that wildfire planning should protect existing residents while allowing new housing.

“They’re using the conversation about wildfires to say ‘we’re going to close our doors,’” Leora Tanjuatco Ross, the group’s California director, said in an interview. “California has a historic housing shortage. We believe you should build housing of all kinds.”
