ISLAMABAD -- Strict new taxation rules could incentivize YouTubers and other content creators in Pakistan to take operations out of the country or receive money in foreign accounts to avoid paying taxes back home, experts are cautioning.

The Federal Board of Revenue said last week that taxable income from creators' content will be actual remuneration received, or estimated earnings based on 195 rupees (70 cents) per 1,000 YouTube views, whichever is higher. Creators' deductible expenses will be capped at 30%, leaving the other 70% as taxable.

The same rate per 1,000 views will apply to creators on Facebook, Instagram and TikTok. Creators below the 70-cent threshold will have to provide evidence to the tax authorities.

In July, Pakistan began requiring banks to withhold a 5% tax when social media revenue reaches a creator's account from such platforms as YouTube, Facebook, Instagram and TikTok.

No comprehensive data is available on the total number of content creators in Pakistan. YouTube owner Google told local media in July that more than 140,000 YouTube channels are managed by Pakistanis. The tech giant did not respond to a request for comment.

Three independent content creators told Nikkei Asia on condition of anonymity that 70 cents per 1,000 views is far too high and unfair to them.

"The videos produced by Pakistani creators and those viewed by Pakistani audience have very small payout rates," one creator said.

"This calculation by FBR is an oversimplification of the YouTube creator's payout system, which is very complex and involves a lot of variables," another said.

Creators could be pushed to shift operations abroad to avoid taxes, according to experts.

"A regime that taxes gross receipts and imposes deemed-income benchmarks may discourage creators from locating and expanding their businesses [in Pakistan], particularly where other jurisdictions tax verified net profits," Ikram ul Haq, who runs a legal and tax consultancy in Lahore, told Nikkei Asia.

Mutaher Khan, co-founder of market intelligence provider Data Darbar, agreed, saying the new rules could trigger Pakistani creators to move out. "Even if they do not leave Pakistan themselves, many may try to establish banking and legal structures overseas," he told Nikkei Asia.

An FBR official authorized to speak to journalists did not comment on a possible exodus of content creators but defended the assumed-income calculation.

The 70-cent threshold "was used because our research and interactions with people making monetized content in Pakistan led us to this figure," the official said.

"This is below average amount a normal Pakistani content fetches per 1,000 views on YouTube across different types of content," the FBR official said. Experts said the problem is not limited to the rough estimation of benchmark revenue per views.

"A minimum tax [for creators] with deductions capped at 30% doesn't reflect the real cost of production for someone with editors, equipment and a team," said Farhad Ahmed Jarral, a communications strategist based in Islamabad. "That's the person who hires, and the one most likely to stop" hiring, he said.

The new tax rules could lead creators in Pakistan to put their income elsewhere, Jarral warned.

"Every extra rupee withheld at the bank is an incentive to route money some other way, through crypto, third-country accounts or informal channels," he said.

"If the goal is formalizing the sector, this pushes in the opposite direction," Jarral said. Adnan Aamir is a contributing writer.
