TAIPEI -- Huawei announced Monday that rival mobile chipmaker Qualcomm would pay to use its patents for the first time, in a cross-licensing agreement covering 5G and AI technologies. The deal marks a breakthrough for the Chinese company's intellectual property portfolio but will trigger a regulatory review in the U.S.
Huawei said Qualcomm will pay to use more than 680 patents, some of themed in the U.S. It did not disclose the value of the deal, but Nikkei Asia has learned it would cross the $133.9 million threshold that would make it subject to approval by the U.S. Federal Trade Commission under the Hart-Scott-Rodino (HSR) Act covering antitrust issues. Qualcomm did not disclose what types of patents or how many it was licensing to Huawei.
The Huawei patents to which Qualcomm has access amount to just 0.23% of the Chinese tech company's 296,248 active or applied for patents. However, they cover key 5G, AI and networking technologies, such as Huawei's near-packaged optics (NPO) interconnectivity tech. They also include patents that use new semiconductor and system design principles, dubbed the Tau Scaling Law Unveiled in May, this approach uses techniques other than the traditional shrinking of transistor sizes to improve performance and is viewed by the Chinese company as a breakthrough after the U.S. imposed strict export controls, making it difficult for it to obtain American technology.
Huawei said its accumulated revenue from intellectual property patent licensing would exceed $6.9 billion following the Qualcomm deal.
Alan Fan, Huawei's chief intellectual property officer, said Huawei's decadeslong investment in fundamental research and development had established its leadership in the mobile industry, and that the agreement with Qualcomm demonstrated its commitment to innovation.
John Han, executive vice president and general manager of Qualcomm technology licensing, said: "This agreement likewise reflects Qualcomm's recognition of Huawei's continued innovation and intellectual property in 5G and other technology fields." He added that "Qualcomm has invested in foundational wireless technologies that have enabled successive generations of mobile innovation and earned broad recognition across the global wireless industry. This agreement reaffirms industry recognition of Qualcomm's 5G technology leadership." Huawei made its first IP license payment to Qualcomm 25 years ago, and the new multiyear agreement marks the first time Qualcomm is the net payer in their cross-licensing agreements.

Huawei, a national champion in China's tech advancement, has been working to counter U.S. restrictions that cut off its access to critical foreign technologies. In September, it rolled out its own smartphone chips with a new processor, the Kirin 9050 Pro, for its triple-fold Mate XT2 handset which applied the Tau Scaling Law for the first time.
