Published today at 2:01 pm (Paris)3 min readLire en français O n October 6, the Democratic Republic of the Congo (DRC) will mark 30 years since the Lemera massacre in South Kivu. On that day in 1996, Lemera Hospital was attacked by elements of the Alliance of Democratic Forces for the Liberation of Congo (AFDL), backed by Rwanda and Uganda. At least 37 people, among them patients and members of the medical staff, were killed.

Lemera was not an isolated episode. It is one of the 617 incidents recorded in the Mapping Report of the United Nations Office of the High Commissioner for Human Rights (OHCHR), published in 2010, documenting the gravest violations of human rights and international humanitarian law committed in the DRC between 1993 and 2003. That report notes that certain acts could, depending on the circumstances and the evidence gathered, amount to war crimes, crimes against humanity, or even acts constituting genocide.

Lemera symbolically marks the beginning of the First Congo War and the opening of a cycle of violence that, thirty years on, continues to devastate the eastern part of the country. Millions of Congolese have lost their lives, millions more have been displaced, and countless women and girls have endured sexual violence. And yet the overwhelming majority of the most serious crimes have still not been brought to trial.

Impunity is not only a denial of justice to the victims. It destroys trust in institutions, deepens trauma, and makes the recurrence of violence more likely. When those responsible for international crimes escape any real sanction, or retain positions of influence, the message sent to would-be perpetrators is devastating: the worst crimes can go without consequence. Yesterday's unpunished atrocities help make today's possible.

Even now, a significant part of North and South Kivu in the eastern DRC remains occupied by the March 23 Movement (M23). Given the decisive influence and direct control that the Rwandan army exercises over the M23, this amounts, in practice, to an occupation of eastern Congo by Rwanda. In this context, impunity for past and present crimes sustains fear, mistrust, and the repetition of violence. ****
