The Andhra Pradesh High Court has allowed construction to proceed but said the project will remain subject to the outcome of a PIL challenging its environmental clearances.

October 6, 2026, 10:24:30 PM IST The Andhra Pradesh High Court has allowed Vizag Hyperscale Data Center Park Limited (VHDCPL), a wholly owned subsidiary of Adani, to proceed with construction of the proposed Google data centre in Visakhapatnam, while cautioning the company to proceed “at your own risk”.
法院明确，该项目的最终走向仍取决于那项质疑数据中心相关许可合法性的公益诉讼的最终判决。该诉讼对项目获批的许可提出了质疑，同时也对项目毗邻森林保护区及水库的选址问题表达了担忧。
The court said the project would remain subject to its final decision in a public interest litigation (PIL) challenging the clearances granted for the data centre. The PIL has questioned the approvals granted for the project and raised concerns over its proximity to a forest reserve and a water reservoir.
诉讼方指出，鉴于项目紧邻森林区域，理应由中央政府出具相关许可，但目前相关审批却是由邦级部门作出的。安得拉邦政府此前已向高等法院说明，目前正审慎行事，确保项目各环节均符合法律规定，并能妥善处理各类环境相关问题。
The petitioners have argued that the project requires clearance from the central government given its proximity to a forest area, while the approvals for the project were granted by state authorities. The Andhra Pradesh government has previously told the High Court that care and caution are being exercised to ensure that all steps related to the project comply with the law and adequately address environmental concerns.
高等法院还强调，企业为该项目投入的任何资金均需自行承担风险；若法院最终裁定叫停该项目，企业也不得以此为由要求获得补偿。负责该数据中心建设的维沙卡帕特南超大规模数据中心园区有限公司为阿达尼集团的全资子公司。
The High Court also cautioned that any investment made in the project would be at the company’s own risk and could not be used as a ground to seek relief if the court ultimately passes orders against the project. VHDCPL, which is undertaking the construction of the proposed data centre, is a 100% subsidiary of Adani.
