Moreno’s bill would also ban federal incentives for data centers and establish a sense of Congress, a nonbinding opinion of the legislative body, that “States and political subdivisions thereof should promptly repeal or reform any tax incentive programs that are specific to data centers.”Federal tax breaks Republicans included in their 2025 megabill were not designed with data centers in mind. But the tech industry’s vast spending on the AI buildout has made it a major beneficiary of these incentives, driving down corporate tax receipts.

In September, Husted tried to pass the Ratepayer Protection Act, which aims to mitigate energy price hikes associated with the buildout, but it was blocked by some Democrats who said it did not go far enough in protecting consumers.
