The Centre on Friday, October 16, informed the Supreme Court that the rules under the Bharatiya Vayuyan Adhiniyam, 2024, have been finalised and approved, as the court heard a public interest litigation challenging arbitrary and exorbitant airfares charged by private airlines.A bench comprising Justices Vikram Nath, R Mahadevan and Aparesh Singh directed the Centre to place the finalised rules before it and scheduled the next hearing for November 16.

Supreme Court hearing on airfare regulationThe latest development follows the Supreme Court’s direction in July 2026, when it asked the Centre to submit the rules framed under the Bharatiya Vayuyan Adhiniyam, 2024, within two weeks. The court had directed that the rules be placed before it in a sealed cover, irrespective of whether they had been laid before Parliament.

At the time, the Centre informed the court that the rules had been prepared and were undergoing translation before being presented to Parliament. The Bharatiya Vayuyan Adhiniyam, 2024, came into force in January 2025.

Earlier, on February 23 this year, the Supreme Court expressed concern over sharp increases in airfares during festive periods and holidays, calling the issue a serious concern. Hearing the PIL, a bench of Justices Vikram Nath and Sandeep Mehta directed the Centre to file an affidavit within four weeks detailing the steps being taken to address the concerns raised in the petition.“This is a very serious concern. Otherwise, we don’t entertain Article 32 petition ,” the bench observed.

The case dates back to November 2025, when the Supreme Court sought responses from the Centre and other authorities on a plea seeking binding regulatory guidelines to curb unpredictable fluctuations in airfares and ancillary charges imposed by private airlines.

The court agreed to hear the petition filed by social activist S Laxminarayanan, who sought the establishment of a robust, independent regulator to ensure transparency and passenger protection across the civil aviation sector. Centre flags rising aviation fuel costsOn October 15, Civil Aviation Minister Kinjarapu Rammohan Naidu said the government wanted airfares to remain affordable, but sharp fluctuations in aviation turbine fuel prices were making this difficult.

The minister said the government was discussing the issue with oil marketing companies and airlines. He stressed that fuel suppliers needed to support the aviation sector and that airlines should draw up a clear plan to address the challenges.

Rising fuel costs have put pressure on airlines globally, prompting carriers to raise fares, cut flights and reduce spending.
