Missouri has urged a judge to reject arguments by three Chinese government-linked entities trying to escape a $24.5 billion judgment tied to the COVID-19 pandemic, arguing they waited more than a year after the ruling to appear in US court and challenge it.
China's Hubei province, the epicenter of the 2019 coronavirus outbreak, and two other defendants chose not to participate in earlier proceedings in the lawsuit, the US state said in a filing in Missouri federal court on Monday.
Missouri said the Chinese defendants, sued by the US state in 2020, “are about six years too late. Seeking a do-over, China tries to contest facts that Missouri established to this Court’s satisfaction.”The Chinese embassy in the US and lawyers for Hubei province at law firm White & Case did not immediately respond to a request for comment. Missouri’s attorney general's office also did not immediately respond to a request for comment.
Missouri in April 2020 filed the first-of-its-kind lawsuit against Hubei and other Chinese defendants, seeking to hold them responsible for alleged economic damages stemming from the coronavirus pandemic. A federal appeals court in 2024 revived part of the lawsuit after a judge dismissed the case. The remaining claim alleges the defendants monopolized supplies of personal protective equipment (PPE), driving up prices and causing economic harm.
US District Judge Stephen Limbaugh Jr entered a default judgment in March 2025 after the defendants failed to respond or make appearances in the case. The damages amount was automatically tripled under federal law after a base finding of $8 billion in compensatory damages.
In August, Hubei and the Chinese Academy of Sciences in a court filing asked Limbaugh to set aside the judgment and dismiss the lawsuit. They argued the district judge has no power over them and that the default judgment improperly intrudes into foreign affairs.
Missouri argues that the lawsuit doesn't impede China's sovereign authority.
(Missouri v. People’s Republic of China et al.)”,审理法院为美国密苏里州东区地方法院(US District Court for the Eastern District of Missouri),案号为1:20-cv-00099-SNLJ。
Hubei province and other plaintiffs are separately suing Missouri in a Chinese court, accusing the state and several officials of damaging their reputations. That lawsuit seeks public apologies in US and Chinese media, and nearly $53 billion in damages. Hubei’s case, filed in April 2025, describes Missouri's COVID-19 lawsuit as a "vexatious lawsuit about COVID-19 spread and Chinese state acts."
