A federal judge in New York, Loretta Preska, has vacated her 2023 judgment that ordered Argentina to pay more than $16 billion over the 2012 expropriation of a majority stake in oil company YPF, formally closing the case at the trial-court level.
The lawsuit stemmed from Argentina's 2012 nationalization of a 51% stake in YPF, which minority shareholders Petersen Energía and Eton Park argued breached the company's own bylaws by skipping a mandatory tender offer. The litigation was financed by Burford Capital, which stood to collect a large share of any payout. An appeals court had already found Preska's court lacked jurisdiction to seize Argentina's YPF shares to satisfy the award, prompting the latest step.
The case's fate now rests with the US Supreme Court, which Burford Capital asked in early October to take up the dispute. A decision to hear the case, or to let the lower-court outcome stand, would shape how much exposure Argentina ultimately faces and how investors price the country's sovereign and corporate risk.
