A Munich court has set a crucial benchmark for the billions of euros in damages being sought by truckmakers’ customers who were overcharged as a result of a long-running price-fixing cartel.
Judges ruled that Volkswagen AG’s MAN must reimburse plaintiffs 5% of the net price they paid for heavy-duty trucks and 1% for medium-duty trucks from 1997-2009. Daimler Truck Holding AG must pay 3.7% for heavy trucks bought and 4.2% for medium-sized trucks that often serve as supermarket delivery vehicles, the court said in an emailed statement on Wednesday.
The claims have hung over Europe’s truck industry for years while drawing relatively little wider attention, in part because they were scattered across hundreds of cases in multiple jurisdictions.
Many have been consolidated in Munich, where one plaintiff group alone filed for about €2 billion ($2.25 billion).
The cases have been closely watched because the damages level set in Munich is likely to become a benchmark across the wider litigation. The suits followed a European Union cartel probe into the industry.
After MAN blew the whistle on the cartel, Daimler, Paccar Inc.’s DAF, Iveco Group NV and Volvo settled with Brussels regulators in 2016, agreeing to pay €2.93 billion for fixing prices between 1997 and 2011.
Scania AB — now also part of Volkswagen’s truck unit Traton SE — contested the allegations unsuccessfully and was fined €880.5 million a year later.
Wednesday’s cases are: LG München, 37 O 6594/17 and 37 O 2959/18.
