The Kamla Nagar Traders Association on Wednesday urged the Delhi government to bring a permanent legal framework to protect existing markets from sealing and demolition, instead of relying on repeated extensions of the National Capital Territory of Delhi Laws Second Act, 2021.
The Act, introduced in the Rajya Sabha in 2021, provides interim protection against punitive actions like sealing and demolition to certain unauthorised developments in Delhi. It has been extended till December 31, 2026, to allow time for regularisation.
The association also sought an interim relief, while a permanent framework is being prepared and implemented.
It said this would help prevent uncertainty and disruption for businesses and families dependent on Delhi's established markets.
In a letter to Lieutenant Governor Taranjit Singh Sandhu and Chief Minister Rekha Gupta, the association sought a permanent legal framework to address the status of existing commercial properties and prevent eligible establishments from facing avoidable sealing or demolition action, subject to applicable laws and court orders.
It said that Delhi's traditional markets have supported generations of traders, shopkeepers and employees, with lakhs of people depending on them for their livelihoods, and added that these businesses also contribute to employment, government revenue and the city's economic activity.
The association also sought a comprehensive regularisation policy for eligible commercial properties in established markets, subject to applicable planning, building safety and environmental requirements.
It said a clear policy would help resolve long-standing concerns while ensuring compliance with relevant regulations, arguing that repeated extensions have created uncertainty about the legal status of their establishments.
It also called for a committee comprising government representatives, the Municipal Corporation of Delhi, planning authorities and market associations to examine the issue and recommend a time-bound solution. The committee should consult stakeholders and prepare a clear roadmap for resolving the matter, it said. The association said urban planning and regulatory compliance should be balanced with the protection of livelihoods.
It urged the authorities to take urgent steps towards a permanent solution so eligible establishments are not left vulnerable when the present legal protection expires.
