A Florida appeals court on Wednesday referred a lawyer to the Florida bar for possible professional discipline after finding her filings in a case bore hallmarks of generative AI output that the panel of judges called “AI slop.”In a brief order, the West Palm Beach-based 4th District Court of Appeal rejected arguments by the attorney, Jaclyn Soroka, that she should not be sanctioned over her filings in a family law case.

The order differs from others in a wave of sanctions rulings regarding lawyers' alleged misuse of AI, most of which have concerned the inclusion of made-up or false AI-generated material in court filings that a lawyer failed to verify.

In the Florida case, the appeals court in September directed Soroka to explain why she should not be sanctioned based on the overall style and content of her submissions. It said she ran afoul of an attorney’s duty to show independent professional judgment, describing her filings as excessively long, unfocused and containing "gibberish" that appeared to be crafted by AI.

Soroka “does not deny using AI but evades the issue and attempts to defend the frivolous arguments discussed in our prior opinion,” the panel said in Wednesday’s order. The court said that “a lawyer taking responsibility for a pleading she signed does not relieve the lawyer of responsibility for the pleading’s contents.”Soroka did not immediately respond to a request for comment. She has denied submitting frivolous material in the case.

“My citations are real, my cases exist, and my language is confident because the record supports it,” Soroka told the court. "Every word I file is a word I have read, judged, verified against its source, and adopted as my own." She acknowledged that a filing in the lower court proceeding contained a false quotation to a prior case. She cited human error and time pressures.

The number of attorneys admitting they used AI carelessly has grown in the three years since the first US court sanction over AI-generated errors. AI errors have now shown up in court opinions, expert testimony and prosecutors' briefs.
