An engineer working at an Nscale data center in Norway has sued the British artificial intelligence infrastructure firm, alleging wrongful dismissal and an illegal subcontracting arrangement.

The engineer alleges that he worked at the site with subcontracting firm CloudBrothers, but that Nscale breached local laws by acting as his real employer. He also alleges CloudBrothers fired him after he raised concerns about employment practices at the site, according to the suit.

The lawsuit, supported by local trade unions, was filed Oct. 16 to Sør-Rogaland District Court and names Nscale and CloudBrothers as defendants.

The suit alleges that Nscale unlawfully used the subcontracting arrangement at its site in Stavanger instead of employing the engineer directly, even though the company directed his day-to-day work and shifts.

Bloomberg earlier reported on equipment failures including cooling system leaks and health and safety concerns in Glomfjord.

The engineer alleges in his suit that he was dismissed in June after challenging a warning from human resources at CloudBrothers that workers would have two weeks of holiday pay deducted if they didn’t submit their vacation requests on time. “You cannot deduct our worked salary,” he replied, copying the whole team, according to the complaint.
