The failure by owners of a former restaurant site to comply with enforcement notices "may be a criminal offence", according to a Jersey minister.

Planning and Regulation Minister Sir Mark Boleat described the situation with the former Nude Dunes restaurant as "unsatisfactory" and something his department was "grappling with".

Nude Dunes at La Pulente in St Ouen's Bay closed down as a restaurant in November 2023 and in 2025 enforcement notices were issued in relation to the site being used as a home and the unauthorised erection of a fence and modular structure. Site owner Nadia Miller declined to comment when approached by the BBC. Responding to a question by deputy Montfort Tadier in the States Assembly, Boleat said: "Non-compliance with the enforcement notice may be a criminal offence, and accordingly it would not be appropriate for me to comment further.

"The enforcement notice remains in effect and has not been complied with." Tadier asked Boleat if "non-compliance over such a long period does anything to instil public confidence in his department and the ability to uphold the rule of law".

The minister responded: "It is clearly very unsatisfactory when there is a compliance and enforcement notice that is not complied with for a lengthy period and I will do what I can to consider how we can best address this problem in the future." Last month a third attempt to get permission for a conversion of the building was rejected by the planning committee.

At the time the site owner Nadia Miller said the proposal "meets all of the criteria set out in the Island Plan" and her appeals continued.
