Technologies should hire a privacy ombudsman to assess whether its artificial intelligence platform is harmful to children, as part of its plan to license some of its technology to Walt Disney Co., a judge said in a bankruptcy court hearing Friday.
US Bankruptcy Judge Brendan Shannon said he would “strongly encourage” the company to hire an expert to evaluate customer privacy concerns over the company’s platform which have sparked lawsuits and investigations by several states. Although Shannon declined to order that an ombudsman be appointed, he said that the move would help alleviate concerns expressed by several state attorneys general.
Shannon made the suggestion at a hearing in federal court in Wilmington, Delaware, where Character filed bankruptcy in order to sell its main assets, which include the technology that Disney is seeking to license. The judge also gave Character permission to hold an auction for the technology, at which Disney would make the opening bid of $20 million. Should no other bidders come forward, Disney would automatically be named the winner.
Character.AI users can text or talk with a variety of bots that have different personalities in order to build unique stories. The platform has described its service as “interactive storytelling” that allows its users to visualize their fan fiction or create different role-playing situations.
Before Character filed for bankruptcy protection earlier this month, the company cut a deal with Disney under which the entertainment giant agreed to pay $5.5 million for the right to hire Character’s employees. That move gives Disney an unfair advantage, Abigail Ryan, an attorney for the states, told Shannon during the hearing.
In court papers filed last week, more than 30 states asked Shannon to leave open the possibility that a privacy ombudsman could be brought into the bankruptcy case. The states objected to the bidding rules because the auction could be tilted in Disney’s favor.
Shannon overruled the states’ objections, but made it clear that when the auction is over and the winner comes before him for final approval of the sale, the states would have a chance to reassert some of their objections.
Character.AI faces probes or lawsuits from state officials in Kentucky, Texas, Florida, Pennsylvania and New Mexico related to its platform, which allows kids to create their own stories and characters as well as chat with AI-derived bots. Users chatting with Character’s AI bots share biographical information, photos and other personal content on the platform, U.S. Trustee Andrew Vara said in an October 27 filing.
Earlier this year, Character settled its then-pending personal injury lawsuits and agreed to ban anyone under 18 from certain chat services, according to a court filing. The company has also been negotiating with a group of state attorneys general to resolve their investigation, Chief Executive Officer Colin Adams said in the filing.
