Investors dumped shares of Bank of America after a steep regulatory penalty caught Wall Street off guard and its third-quarter earnings missed forecasts, putting the second-largest bank on pace for a bruising day.

Bank of America sought to reassure the street on a call with analysts to discuss results released early Wednesday, hours after the Treasury Department slapped the bank with a $1.2 billion fine tied to what officials called insufficient systems to monitor and report possible financial crimes. The third-quarter results came in short of Wall Street expectations, even with the regulatory fine excluded.

At midday the stock had dropped roughly 6% to around $51 a piece, while the broader market and other bank stocks were slightly lower. It was on pace for its largest percent decrease since April 2025 when tariff chaos hammered banks, and it has now lost 20% since its high in August.

Bank of America executives said the bank has been working with regulators for a number of quarters and invested billions of dollars to combat financial crime. Related expenses have been factored in after the fine knocked 17 cents a share off its earnings for the quarter that ended in September.

Chief Executive Brian Moynihan told analysts the bank had “resolved the government discussion” after some back and forth with regulators“The key was to get agreement to what the resolution was, and that we have,” Moynihan said.

Analysts on the call pressed Bank of America on confidence issues because of the regulatory fine, which included a record $750 million civil money penalty from the Office of the Comptroller of the Currency, and questioned whether there was more to come.

JPMorgan analyst Vivek Juneja called it a surprise after the bank earlier said the issue was already factored into the run rate.

“Yet clearly you’ve had a huge charge this morning,” he said on the analyst call. “Obviously it’s a reputational and confidence issue.”Bank of America said profit fell to $6.9 billion for the third quarter, while revenue increased to just shy of $30 billion. Sales and trading revenue was down around 5% from a year earlier.

Separately on Wednesday, Bank of America was among the institutions the OCC again alleged had improperly closed accounts of customers. Banks have said decisions to avoid certain industries or clients are in accord with anti-money-laundering laws or are in response to other regulatory pressures.
