The President of the International Court of Justice, Yuji Iwasawa of Japan, kept mum at the United Nations on Thursday on the question that may upend his court. The Gambia v. Myanmar, the case in which the ICJ is poised to lower the threshold for proving genocide, merited only a passing mention. By contrast an asbestos problem in the court’s building received three paragraphs.

Make no mistake, Myanmar is atop Mr. Iwasawa’s mind. Mike Waltz, the U.S. Ambassador to the U.N., made sure of that last week. The ICJ’s looming move, Mr. Waltz argued in a public statement, is being prepared in Myanmar “so that weakened and false [genocide] standard can later be weaponized against American and allied soldiers whenever they raise a finger against terrorists that hide behind civilians.”

The court is now on notice. “As our actions against the ICC demonstrate,” Mr. Waltz continued, “we will not allow globalist, faux-judges to weaponize the law against our troops, undermine our sovereignty, or put American lives at risk.”On Oct. 9 the U.S. sanctioned the International Criminal Court, which prosecutes individuals rather than adjudicating disputes between states as the ICJ does.

Both courts in The Hague have been under pressure from the international left to expand their remit to handcuff Western policy. The difference is that Mr. Iwasawa and the ICJ have already seen what happened to the ICC when it crossed the line from law to politics. Does he want to do the same, and put his court in similar peril?

U.S. concerns are well-founded. As Andres Munoz-Mosquera, chief legal adviser to NATO’s Supreme Allied Commander from 2014-25, explained in these pages, “A new and malleable [genocide] standard could become a precedent through which virtually any military campaign involving substantial civilian casualties is recast as a genocide claim.”The result would be to “undercut democracies’ ability to fight terrorists and autocrats.”That’s the goal.

Everyone knows why the global left wants to redefine genocide, and it has nothing to do with Myanmar’s mistreatment of the Rohingya. That can be found genocidal with no change in legal standard. The change would be needed only to help South Africa’s case against Israel—where the evidence falls far short—and then to hold over the U.S. as a threat.

We hope Mr. Iwasawa and fellow judge Bogdan Aurescu of Romania enjoyed their trips to New York this week. Unless something changes to avert U.S. sanctions, it could be their last. As Mr. Waltz made clear, their court’s credibility and its future are at stake.
