Senate confirmation hearings are often filled with vague promises and deflective answers. But this was not the case when now-Director Erica Schwartz of the Centers for Disease Control and Prevention declared, “Senator, you have my commitment.“ She was affirming that data collection on abortion is a critical component of her agency’s work.
For the sake of women and their healthcare providers, Director Schwartz must keep to her word.
National abortion data collection is older than Roe v. Wade itself. As states began to liberalize their abortion laws in the late 1960s, the CDC established the Abortion Surveillance System to track abortion-related maternal mortality and morbidity, collect demographics of abortion-seeking populations, and monitor unintended pregnancies.
Voluntary state reporting measures were rightfully deemed necessary public health controls. These only became associated with anti-abortion efforts after women’s safety had been subordinated to abortion access by the abortion legalization movement.
The CDC has published its annual abortion surveillance series since 1969, traditionally in late November. Despite known underreporting, this series is critical for informed consent practices, allowing women and their providers access to the full scope of risks associated with abortion when making decisions about their pregnancy.
But for the first time since the series outset, the CDC failed to publish this report in 2025, citing agency cutbacks. This missed report notably was to include abortion surveillance from 2023, the first year following the Dobbs decision. That year is especially important because the shifting landscape of abortion law in the fallout of Roe had not settled by the end of 2022. State restrictions were subject to ongoing litigation, and many laws faced immediate injunctions.
Abortion providers have also shifted increasingly toward telehealth dispensing models, circumventing state-level laws intended to curb national abortion numbers. Surveillance from 2023 will offer a first picture, however blurred or incomplete, that women will have into abortion risk post-Dobbs.
Unfortunately, as recent news suggests, failure to provide timely reports on abortion safety seems to be a theme for this administration. Both sides of the abortion debate, and the mainstream media, are focused heavily on the Food and Drug Administration’s review of the medication abortion drug, mifepristone, and the continued delay of public results until next March. But this disregard of more than half a century of longitudinal abortion data collection is also a departure from the administration’s “Gold Standard Science” maxim and raises questions about the commitment to its own transparency standard.
Director Schwartz, even aside from the commitment she made in her confirmation hearing to Sen. Josh Hawley (R-Mo.), must prioritize the release of this post-Dobbs data and ensure the 2026 report is released on time.
Public health is a service to the populace. Data cannot be withheld for fear it will be weaponized by ideologues. Although federal abortion policy has increasingly become a data war, surveillance informs regulatory action to protect women from potential harms. To hide data is to force women to make decisions in the dark.
Moreover, although Congress alone has the authority to mandate federal reports from the states, but that does not leave the CDC without responsibility to provide the states with a top-down standard that reflects what patient-deidentified elements should be reported.
In the era following Dobbs, where medication abortions comprise nearly two-thirds of all abortions, the CDC should request that states volunteer specifications that enable intergovernmental accountability for compliance with the drug’s use. To ensure compliance with federal drug regulations, states should also track and report the serial and lot numbers for abortion drugs prescribed along with drug expiration dates.
And even in states where abortion shield laws protect out-of-state prescribers from criminal and civil penalties for mailing abortion drugs to women in states where it is illegal, the CDC should request that states record the abortion providers who prescribe the drugs, the prescriber’s state, and whether the medication abortion was completed at the provider’s facility or at home — of course keeping all patient information confidential.
Public health organizations are not political pawns. Schwartz must not forfeit the CDC’s commitment to data transparency, or to the women and healthcare providers it informs.
