A US federal judge blocked the Trump administration from penalizing two human rights organizations communicating with the International Criminal Court (ICC), ruling that the measures unconstitutionally restrict free speech.

US District Judge Jesse Furman granted a preliminary injunction, determining that the federal prohibition against providing services to sanctioned ICC personnel constitutes a content-based regulation of speech that fails strict scrutiny.

(Democracy for the Arab World Now,简称DAWN)和“纳税人反种族灭绝联盟”(Taxpayer Alliance Against Genocide,简称TAAG)执行最高377,700美元的民事罚款或最高20年监禁的刑事处罚。

The ruling bars federal agencies from enforcing civil fines of up to $377,700 or criminal penalties of up to 20 years in prison under the International Emergency Economic Powers Act against plaintiffs Democracy for the Arab World Now (DAWN) and the Taxpayer Alliance Against Genocide (TAAG). DAWN had routinely submitted war crimes evidence filings under Article 15 of the Rome Statute. TAAG was formed to prepare similar submissions but had withheld filing out of fear of prosecution.

The rights groups welcomed the victory and announced they will immediately resume submitting evidentiary documentation to the tribunal, restart formal coordination with UN Special Rapporteur Francesca Albanese and re-engage with Palestinian human rights bodies Al-Haq, Al Mezan, and the Palestinian Centre for Human Rights.

ICC measures The litigation challenged Executive Order 14203, issued in February 2025, which directed federal agencies to impose tangible consequences on entities tied to investigations targeting the US or allies such as Israel that have not consented to ICC jurisdiction.

The order targeted former ICC Prosecutor Karim Khan, six judges and UN personnel.

US Secretary of State Marco Rubio announced last Friday that Washington imposed sanctions on the court, warning that the US would dismantle the tribunal if member nations fail to rein in its authority.

US pressure intensified after the court issued arrest warrants in November 2024 for Israeli Prime Minister Benjamin Netanyahu and his former Defense Minister Yoav Gallant for alleged war crimes in the Gaza Strip. The ICC has 125 member states, while neither the US nor Israel is party to the tribunal.
