A federal judge on Wednesday ordered Wanying “Heather” Zhang be held in custody, after her lawyers – who had fought to keep her out of jail – said she “looks forward to establishing” her innocence at trial.

They argued that the US government’s case centred on a single day of alleged surveillance in Seattle and was not evidence that she posed a flight risk.

US Magistrate Judge Steve Kim sided with prosecutors, who told him that Zhang’s parents and siblings lived in China and that her brother had a history of working with the Chinese government.

“The alleged surveillance began and ended on a single day, September 1, 2025,” Zhang’s lawyers wrote in a brief opposing her continued detention. The government’s complaint, they said, “charges a single violation” of the unregistered-agent statute arising from that day in Seattle.

“For purposes of this detention hearing only, Ms Zhang accepts the allegations of the complaint as true, as the court must at this stage,” the brief said. “She does not concede them. She contests the charge and looks forward to establishing her innocence at trial.”In a brief filed for Wednesday’s detention hearing, the defence argued that the timeline was central to the question of whether Zhang should remain in custody while the case proceeds. The lawyers wrote that the alleged surveillance took place on September 1, 2025, while the communications cited in the case ended in October 2025.

The argument came three days after the FBI arrested Zhang, 34, at Los Angeles International Airport as she prepared to board a one-way flight to China.

The FBI has said the flight was bound for Shanghai. The US government filed its criminal complaint in secret and seized her US passport. The FBI found no Chinese passport.

The case has drawn attention because Washington accuses Beijing of using an American citizen of Chinese origin to conduct surveillance against the son of Taiwan’s leader, William Lai Ching-te, on American soil.

According to the FBI, Zhang and an associate filmed outside the suburban Seattle home of Lai’s son on September 1, 2025. Zhang allegedly sent photographs and video, along with vehicle licence-plate numbers, to a handler in China.

Messages cited by prosecutors include: “Saw him. Young male. It’s that young one” and “I am videorecording”.

Zhang is accused of acting in the US as an unregistered agent of the Chinese government, a federal offence carrying a potential sentence of up to 10 years. She has not been indicted and is presumed innocent.

The defence said the government was using Zhang’s arrest at the airport and her one-way ticket to China to argue that she might flee. Her lawyers pointed instead to the 13 months between the alleged surveillance and her arrest, during which she travelled abroad, including to China, and came home each time.

“A person cannot avoid proceedings she does not know exist,” the filing said. “A person who means to flee to China does not fly there and come home, again and again, to her husband and daughters.”Zhang’s lawyers said the trip that ended with her arrest had been planned weeks earlier so she could visit her mother. She delayed the trip until after her daughters’ birthdays, the brief said. Her lawyers also said she routinely bought one-way tickets and purchased return flights separately.

The defence also challenged a pretrial services report, relaying the case agent, that Zhang may hold Chinese citizenship, a factor cited in support of keeping her detained. The brief said the agent identified no source.

Zhang came to the US in 2014 and became a US citizen in 2020. She has worked in Orange County real estate for roughly a decade and has been married since 2017 to a US citizen. The couple’s daughters are eight and five, and the family lives in an Irvine home purchased in 2021.

“Ms Zhang earned her place here,” the defence wrote. “Her husband, her daughters, her home and her work are all here, and she is not leaving them.”Under the defence proposal, if released, Zhang would be placed under GPS monitoring and home detention and barred from airports. Her family and a friend would also put up more than US$800,000 in guarantees, with the Irvine home – which the defence said had at least US$700,000 in equity – offered as security.

The judge rejected that proposal. Zhang is due back as early as October 19 for a preliminary hearing, unless prosecutors indict her first.

Zhang’s case is the latest in a run of prosecutions accusing Chinese-Americans in the US of acting for Beijing without notice. The outcomes have been mixed.
