John Podesta

Hasn’t John Podesta done enough damage to U.S. energy policy? Apparently not. The architect of Joe Biden’s harmful pause on new liquefied natural gas exports is now trying to poison a bipartisan permitting reform because it could benefit fossil- fuel production.

[audio] Bibi Survives / A Delectable Cheesecake Factory Fight We recently told you about a draft Senate deal that would accelerate federal permitting and reduce frivolous litigation. It could get a vote in the lame-duck session of Congress. While imperfect, the compromise provides much-needed certainty for developers by banning federal agencies from cancelling or suspending permits.

It would also let permit holders sue the feds for damages if the government does a switcheroo. Democrats demanded such “certainty” provisions out of frustration with the Trump Administration’s moves to revoke permits for offshore wind projects.

Yet Mr. Podesta called these provisions a poison pill in remarks Friday at the University of Colorado, Boulder, which were reported by the climate site Heatmap. Lawmakers have “handed Trump . . . a loaded Howitzer to go after public lands, to permit stuff that even if it’s illegal can’t be reversed by the courts,” Mr. Podesta reportedly said.

The Trump team is “going to have a permit gorge like you’ve never seen, not really caring about whether they’re going through the legal steps to do it, and under this bill, those can’t be reversed,” the Biden climate adviser said. The bill removes “states’ ability to ensure clean drinking water” and “a lot of restraint on the ability to get courts to enjoin for NEPA violations.”How does he mislead, let us count the ways. The bill doesn’t alter the National Environmental Policy Act’s requirements that agencies review and mitigate potential environmental impact of projects on federal land. It merely imposes a shot clock on the completion of environmental reviews and a 150-day statute of limitation to challenge permits.

The bill also instructs courts to provide “substantial deference” to an agency on the “scope and contents” of an environmental review, which is intended to prevent judges from second-guessing agencies.

None of this is a license to allow unfettered drilling in Yellowstone, as Mr. Podesta suggests. While the bill would limits states’ ability under the Clean Water Act to withhold permits based on hypothetical indirect effects on water quality, states would retain authority to block projects if they create discharges that pollute waterways.

Mr. Podesta’s real beef is that the compromise could make it harder for a future Democratic administration to reprise his LNG “pause” and rescind permits for fossil-fuel projects. It could also prevent the climate crowd from weaponizing the courts. Never mind that the deal would limit Mr. Trump’s power to block renewable-energy projects.

The deal would also assist green energy by letting the Federal Energy Regulatory Commission override states and approve transmission lines in the “public interest.”Yet Mr. Podesta suggested that Democrats should hold out for a better deal since they will have more leverage if they take control of Congress.

Don’t be so sure. Mr. Trump may be less inclined to strike a deal with Democrats next year. Then again, Mr. Podesta may know this. For the implacable climate left, keeping fossil fuels in the ground is all that matters.
