Mr Robinson’s team argued that the complexity of the case and the volume of evidence meant they needed significant time to prepare for a trial.
Prosecutors expect any criminal trial would last around four months, while Mr Robinson’s team said they were preparing for a trial to take six to seven months.
Mr Kirk was killed by a single shot to the neck while he was debating students at one of his popular “Prove Me Wrong” events at a university campus in Utah on Sept 10, 2025.
The death of the Right-wing activist prompted concerns about a new era of political violence in the US. Mr Trump, who credited Mr Kirk with helping him secure the youth vote in the 2024 presidential election, said the online influencer was “a martyr for truth and freedom”.
Prosecutors alleged in a pre-trial hearing in July that CCTV footage from the scene showed Mr Robinson walking around the Utah Valley University campus on the day Mr Kirk was killed. They claimed separate footage showed him scrambling to a rooftop, crawling along the gravel on his front, and then fleeing on foot moments later. Mr Robinson’s team denied the man in the CCTV footage was him.
Lance Twiggs, Mr Robinson’s former lover, also alleged that the defendant said he wished he “hadn’t done it” the day after the shooting. In a recorded interview with police, which was played at the pre-trial hearing, Mr Twiggs said Mr Robinson was pacing around their shared apartment on Sept 11, 2025.
He said the pair had a conversation later that day. “He started crying a little bit and said he wishes he hadn’t done it, and then kept going around and just doing stuff, I think to keep himself busy or distracted or something,” Mr Twiggs said. “Eventually he said that he would talk to his parents or turn himself over,” he added.
