By Declan Harty A top Wall Street regulator sued Utah on Tuesday over its attempted clampdown on the prediction market platform Kalshi, escalating a nationwide clash between President Donald Trump’s administration and the states.

The Commodity Futures Trading Commission’s lawsuit alleges that the Beehive State cannot use state law to regulate Kalshi, as the prediction market giant is exclusively overseen at the federal level. Utah sued Kalshi last week on the grounds that the company is operating an illegal gambling business in the state, a charge the company rejects.

Led by Chair Michael Selig, the CFTC has been locking horns for months with states across the country over who gets to regulate the prediction markets — one of the hottest corners of the financial industry. Selig’s agency argues that the companies are federally regulated financial exchanges that solely fall under the CFTC’s watch. But state officials say the prediction markets are simply newfangled gambling platforms, and should be overseen at the state level. The Supreme Court is currently weighing a bid by New Jersey officials to take up the issue.

“Utah seeks to shut down prediction markets across a wide variety of markets,” Selig said in a statement Tuesday. “Congress entrusted the CFTC to be the federal regulator with sole responsibility to oversee these markets. As I’ve said before, the CFTC has the expertise and responsibility to defend its exclusive jurisdiction over commodity derivatives, and that’s exactly what we’ll do.”

Spokespeople for Utah Gov. Spencer Cox and Attorney General Derek Brown did not immediately respond to requests for comment about the CFTC’s lawsuit. Earlier this year, speaking at a POLITICO event, Cox blasted the notion that the CFTC should be in charge of regulating the platforms as “a joke.”

Kalshi spokesperson Jacki McGavick said in a statement that the company, as a federally regulated financial exchange, “answers to federal law, and no single state should have a veto over it.”
