The Hong Kong government’s sweeping reforms to crack down on bid-rigging are intended to bring about a “revolutionary overhaul” of the city’s building maintenance ecosystem, the justice minister has said.
在政府针对大埔火灾独立委员会报告公布一系列措施的三天后，律政司司长林定国在周日的一档电台节目中表示，拟议的修例旨在提高标准并加强监管。
Three days after the government unveiled a range of measures in response to an independent committee report on the Tai Po fire, Secretary for Justice Paul Lam Ting-kwok said the proposed legislative amendments aimed to raise standards and strengthen oversight.
“市场目前提供了一块太诱人的‘肥肉’，已被坏人垄断，”他在周日的一档电台节目中表示。
“The market currently offers too lucrative a piece of ‘fat meat’ that has been monopolised by bad people,” he told a radio programme on Sunday.
他强调，有必要通过新立法将坏人驱逐出市场，以便信誉良好的专业人士愿意重新进入。
He stressed the necessity of driving bad actors out of the market through the new legislation so that reputable professionals would be willing to re-enter.
林定国表示有信心，包括将围标刑事化在内的修例将根除该装修行业几十年来存在的问题。
Lam expressed confidence that the legislative amendments, including criminalising bid-rigging, would eradicate the decades-long problem within the renovation sector.
“[整套立法]将对整个大型楼宇维修生态系统进行革命性的彻底改造，”他说。
“[The whole legislation package] will be a revolutionary overhaul of the entire ecosystem of major building maintenance,” he said.
商务及经济发展局局长丘应桦在同一档电台节目中表示，围标是一个复杂的问题，不仅涉及招标过程本身，还涉及固定价格和划分市场等其他反竞争行为。
Secretary for Commerce and Economic Development Algernon Yau Ying-wah said on the same radio programme that bid-rigging was a complex issue involving not only the bidding process itself, but also other anticompetitive practices such as price-fixing and market-sharing.
丘应桦表示希望将围标刑事化能带来更大的执法权力，并补充说他预计新法例将于明年4月获得通过。
Yau expressed hope that criminalising bid-rigging would result in greater enforcement powers, adding that he expected the new legislation would be passed by April next year.
为回应由法官领导的独立委员会对去年造成168人死亡的宏福苑火灾的调查报告，当局将把这一新罪行纳入《有组织及严重罪行条例》和《廉政公署条例》之下，以加强执法机构的权力。
In response to the report by a judge-led independent committee investigating the fire at Wang Fuk Court that claimed 168 lives last year, authorities will bring the new offence under the Organised and Serious Crimes Ordinance and the Independent Commission Against Corruption Ordinance to strengthen the powers of enforcement agencies.
拟议的修订针对围标、价格合谋、市场剥削和产出限制。个人和公司都可能承担刑事责任。
The proposed amendments target bid-rigging, price-fixing, market exploitation and output restrictions. Both individuals and companies could be held criminally liable.
拟议的最高刑罚为监禁10年及罚款1000万港元（130万美元），或按违反规定所获收益的三倍、或者按公司在犯案各年本地营业额的50%处以罚款。
The proposed maximum penalty is 10 years’ imprisonment and a fine of HK$10 million (US$1.3 million), or alternatively three times the gains derived from the contravention or 50 per cent of a company’s local turnover for each year of the offence.

Authorities will also set up a task force, combining intelligence and enforcement powers from police, the Independent Commission Against Corruption and the Competition Commission to combat bid-rigging.

Authorities said earlier that intelligence sharing would allow the three agencies to engage at an earlier stage of investigations, with each bringing its own database to increase efficiency and uncover the masterminds behind bid-rigging syndicates.
