Germany’s top court has ordered Economy Minister Katherina Reiche to remove an Instagram video from her ministry’s official account in which she accused the Left Party of openly embracing antisemitism.
联邦宪法法院周四公布的一项临时裁决称，从官方政府账号分享此类主张可能侵犯社会主义左翼党平等参与政治竞争的权利。
The Federal Constitutional Court said in an interim order published on Thursday that sharing such claims from an official government account may violate the socialist Left Party’s right to equal participation in political competition.
法院表示，“鉴于柏林市州政府组建问题的持续讨论，这一点尤其相关”，指的是左翼党在9月20日德国首都选举获胜后的探索性谈判。
“This is particularly relevant given the ongoing discussions regarding the formation of a government in the city-state of Berlin,” the court said, referring to exploratory talks after the Left Party’s election victory in the German capital on Sept. 20.
法院称，“有争议言论的持续传播可能会严重损害申请人在公众眼中的形象，也可能使潜在的联盟伙伴更难与其达成联盟协议。”
“The continued circulation of the statements in question is capable of severely discrediting the applicant in the public eye. This could also make it more difficult for potential coalition partners to enter into a coalition agreement with it,” the court said.
法院补充说，“因此，可能会产生远远超出针对申请人的负面描述的政治现实。”
“Consequently, political realities could be created that extend far beyond the negative characterizations directed at the applicant,” it added.
法官们以6比2的投票裁决，该视频必须在对左翼党投诉作出最终裁决之前一直下线，期限不超过六个月。
The judges ruled 6-2 that the video must remain offline until a final decision on the Left Party’s complaint, for no longer than six months.
法院未裁定赖希的言论是否违宪，并强调，她作为政治家或私人公民，仍有权就该话题发表观点。
The court did not rule on whether Reiche’s remarks were unconstitutional and stressed that she remains free to express her views on the topic as a politician or as a private citizen.
左翼党在该部委拒绝其要求于9月29日前删除视频后，将此案提交给位于卡尔斯鲁厄的法院，认为联邦部委不得利用国家资源和官方权力反对某个政党。
The Left Party took the case to the Karlsruhe-based court after the ministry refused its demand to delete the video by Sept. 29, arguing that a federal ministry must not use state resources and official authority to campaign against a political party.
赖希是总理梅茨所属的中右翼基民盟的一位保守派政治家，她通过律师辩称，其言论符合宪法，并未违反政府的政治中立义务。
Reiche, a conservative politician from Chancellor Merz’s center-right CDU, argued through her lawyers that the remarks were constitutionally sound and did not violate the government’s duty of political neutrality.

In the clip, posted on Sept. 24 and taken from a speech she gave a day earlier at a business event, Reiche warned against a possible Berlin government involving the Left Party, criticizing its long-standing plans to expropriate large private housing companies as a response to soaring rents.

The Left Party’s lead candidate in Berlin, Elif Eralp, has repeatedly dismissed claims of antisemitism against her and the party. She said party leaders had distanced themselves from a small number of isolated incidents at some campaign events.

She added that the Left Party opposes all forms of racism and noted that during her career she has been involved in projects combating antisemitism.

Eralp’s Left Party won Berlin’s city-state election on Sept. 20 with 25.7% of the vote, more than doubling its share from three years ago. The party is currently holding talks with the center-left SPD and the environmentalist Greens on forming a potential coalition government.
