The UK’s use of anti-terror powers to outlaw Palestine Action has led to the group’s total destruction, its lawyers said at the UK’s highest court in the latest attempt to overturn the ban.
The designation, which places Palestine Action in the same category as groups like al-Qaeda, has led to thousands of arrests for supporting a group many of whose actions “were not even criminal,” Raza Husain, a lawyer for the group, told Supreme Court judges on Wednesday.
Debate around the conflict in Gaza has laid bare political tensions in the UK, particularly for the governing Labour Party that has walked a fine line between defending longtime ally Israel and speaking out for the human rights of Palestinian citizens — a move that has provoked ire from the left of the party.
Palestine Action initially overturned the ban at the High Court had, but in June an appeals judges sided with government’s original decision. Supreme Court judges will hear arguments over Wednesday and Thursday with a decision expected in the New Year.
Just three of a total 385 acts of protest the group carried out in a five-year period met the government’s definition of terrorism, the group’s lawyers argued. The ban is a disproportionate response to activities that have included damaging military aircraft, and violates a human right to protest.
Lawyers for the government said in court filings that the three incidents defined as terrorism were in line with the group’s guidance to its members, and accused them of serious violence. They said the ban was lawful and proportionate.
The group had “specifically promoted its attacks and sought to radicalize others” and “encouraged others to undertake serious damage to property,” they said.
The government previously said that ministers must retain broad powers to act against threats to national security and insisted the ban was aimed at violent and criminal conduct, not peaceful protest. Civil liberties groups, campaigners and some Labour lawmakers said using terrorism powers against the protest group risked criminalizing dissent and chilling legitimate criticism of Israel’s government.
“This decision does not affect lawful protest in support of the Palestinian cause, which remains a fundamental democratic right,” Shabana Mahmood, the Home Secretary, said in July. “There is a difference between supporting Palestine and supporting a proscribed terrorist group.”There are around 700 criminal cases against Palestine Action protestors waiting to go to trial or plea. More than 3,000 people have been arrested since the designation came into effect.
